Plain terms for a plain instrument.
This page covers two things: using this website, and using the free, self-hosted Orrery core. There is no account to agree to anything for yet, no hosted service to bill you, nothing to click "I agree" on. It is here so the terms are stated before any of that exists, not after.
What you are actually agreeing to.
Three facts cover most of it. The rest of this page fills in the detail.
Free, open core.
AGPL-3.0-or-later. Run it, read it, modify it, self-host it, at no cost, on your own machines.
Informational only.
Static pages. No account, no login, no form that submits anywhere, nothing purchased here today.
Does not exist yet.
Plans shown elsewhere on this site are pre-order and early access. When a hosted service launches, it gets its own terms.
The software: license, and no warranty.
AGPL-3.0-or-later, and a separate commercial license
The Orrery core is licensed under the GNU Affero General Public License, version 3 or later (AGPL-3.0-or-later). In plain terms: you may run it, study it, modify it, and self-host it at no cost. If you distribute it, or run a modified version as a network service others use, the AGPL's copyleft terms apply, including making corresponding source available to those users. A separate commercial license is available for organizations that need terms outside the AGPL, for example to distribute a modified version without the AGPL's source-availability obligations. Contact us if that describes your situation.
Provided as-is, no warranty
The software is provided as-is, without warranty of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, or non-infringement. This is consistent with, and not broader than, the disclaimer already built into the AGPL itself. Nobody is promising it is bug-free, that it will keep running, or that it fits your particular fleet or workflow.
Limitation of liability
To the maximum extent permitted by applicable law, and consistent with the AGPL's own limitation of liability, Evening Star Productions is not liable for any damages arising from the use of, or inability to use, this software, including direct, indirect, incidental, or consequential damages, even if advised of the possibility of such damages.
Acceptable use.
Using this site
This site is informational: read the pages, follow the links to source, documentation, and licensing. Do not attempt to disrupt, overload, or attack it. There is no account to misuse and no data submitted here to abuse, so there is not much surface beyond that, but the expectation is the ordinary one for any public website.
Using the software
You are responsible for how you configure and operate Orrery, including which boxes it reaches and which secrets it sits near. The reconciler only reaches what a profile you write explicitly declares; there is no discovery step that reaches out on its own. Use it only against infrastructure you are authorized to operate, and in compliance with applicable law.
What exists today, stated plainly.
Today, this site is fully static: no accounts, no login, no form that submits data anywhere, no purchase flow. Any pricing or plan names shown elsewhere on the site describe a hosted control plane that is pre-order and early access, not a live, billed product. Nothing is charged to you through this site as it stands.
When a hosted service exists.
If and when Evening Star Productions launches a hosted, account-based version of Orrery, use of that service will be governed by its own terms of service, presented to you and agreed to separately at signup. Those terms will sit alongside, not replace, the AGPL that continues to cover the self-hosted core. This page will be updated to link to them once they exist.
Changes to these terms.
These terms may be updated from time to time, most likely as the hosted service takes shape or as the software's scope changes. When they are, the effective date at the top of this page will change. There is no notification list to sign up for; check back if it matters to you.
